Position Purpose

The Chief Compliance Officer provides reasonable assurance with respect of applicable laws and regulations within the Territories. Furthermore, the Chief Compliance Officer is responsible for developing and maintaining an adequate Compliance framework and governance structure in the Territories.

The territories covered are Singapore, Indonesia, Malaysia, Thailand & Vietnam.

Responsibilities

He/she is responsible for the compliance of the entities in the Territories under his/her scope

  • He/she validates the policies to be adhered by the Territories and controls that they are respected and implemented by achieving a twofold objective:
- Independence of decisions; binding advice

- Close partnership with the business to provide them strong second levels of control, guidance and advisory
  • He/she is responsible for cultivating and maintaining a strong Compliance culture within the Territories
  • He/she is responsible for developing and maintaining a strong Compliance framework and structure within the Territories
  • He/she provides reasonable assurance on securing and preserving BNP Paribas\xe2\x80\x99s corporate culture and reputation
  • He/she is the preferred point of contact for the Head of Territory/CEO
  • He/she works in close cooperation with the other senior Compliance Officers (COs) in the Territories business line heads to ensure consistency of decisions and operating models
He/she is responsible for maintaining and improving relationships with all relevant local regulators and authorities.

The Chief Compliance Officer is responsible for the following activities:
  • Provides reasonable assurance towards the Head of Territory/CEO, business heads, CCO, relevant Bank\xe2\x80\x99s governance bodies for the Territories, APAC Compliance ExCo, Bank\xe2\x80\x99s clients, the market, society, Bank\'s governance bodies (where applicable), and all relevant regulators, on the compliance of the Bank and its employees\xe2\x80\x99 operations / activities / conduct with applicable laws/regulations/practices, and ensures action plans are launched for perceived weaknesses
  • Furthermore, it is important to ensure that if action plans are implemented, that these implementations work well enough to improve perceived weaknesses.
1) Ensures consistency of the Compliance model and policy within the Territories:
- Defines how Compliance rules will be adapted / implemented in coordination with the Compliance Domains and the Business Lines
- Coordinates diffusion of policies and adaptation into operational procedures
- Supervises consistency of implementation
2) Controls the effective implementation of Compliance rules
3) Controls the effective implementation of Compliance tools & systems (with the support of the Compliance COO office and IT)
4) Makes Compliance decisions on issues reported by local teams in his/her scope of responsibility, involving the Compliance Domains when relevant
- Exercises decision rights for intermediate level cases
5) Provides support and guidance to territory teams * Ensures the interface between the business (preferred point of contact of the Head of Territory/CEO) and the regulatory authorities on his/her Territories, in coordination with the Compliance Domains & Business Compliance heads:

- Establishes close partnership with the business
- Provides strong guidance and advisory for their business development: advisory on Territories level, formal agreement for intermediate level cases on the Territories * Aggregates and reports risk on territory-specific issues and mitigation plan to the CCO in regular one to one calls/meetings, and to the Territory Management Meeting (monthly basis).
  • Establishes an appropriate governance to manage risk of non-compliance: leveraging Business Lines COs expertise, Leveraging Domains COs expertise
  • Leads, manages and supports Compliance teams in the Territories:
- Helps to organize and facilitate the Territory Compliance Committee (per head of Territory Charter) at least twice a year, which is chaired by Head of Territory
- Validates priorities for his/her N-1
- Identifies required improvements of organization, tools and processes
- Takes final decisions for his/her N-1 on recruitments and performance appraisal
- Identifies local training needs and monitors the Compliance line training plan for Compliance staff, other functions and the business
- Implements controls, as well as tools & systems * Manages the operational Compliance budget for the Territories:

- Consolidates Compliance budget at a Territory level, including sponsorship of related tools in full accountability per delegation rights to the CCO
- Aligns budget with Operational Perimeters (as applicable) whose entities are managed by the Territories * Manages, and is responsible for, development of skills and expertise of local COs by providing necessary education and guidance.
  • Manages, and is responsible for looking after the welfare of local COs
  • Is also responsible for driving the change required within the Compliance Function and in the interaction with the business.
Additionally, in the context of the new orientation of compliance, the Chief Compliance Officer will:
  • Support and/or contribute to the definition of risk-based approaches where applicable and engage local regulators to secure concurrence on the target framework
  • Support and/or contribute to the redistribution of responsibilities in the management of compliance risks and, in coordination with APAC domains & Business Compliance teams, accompany the business to take over activities, that shall be delegated to the 1LOD
  • Support the industrialization of compliance activities through process reengineering & digitalization
  • Take ownership of the notified budget, optimizing the usage of T&E expenses, assessing HR impacts & taking action to meet headcount objectives & communicating the new budget context to the teams to secure engagement and minimize adverse reactions
  • Promote a pragmatic mindset in the teams, encourage initiatives aiming at simplification & renunciation of tasks
  • Apply the delegation principle, taking into account the skillset and the maturity of each individual & encourage trust at all levels

Experience and Qualifications preferred
  • At least 3-4 + years\xe2\x80\x99 experience in a senior Compliance management role at another top tier firm. Overall at least 15 years of relevant work experience in an international banking organization(s) handling/advising on a broad range of banking products in a Compliance, Legal and/or Risk capacity.
