Responsibilities

: " Our client is in the upstream Oil & Gas industry and they have a few job openings for the Lead Contracts Specialist position Summarize the Major Function and Purpose of the Position Contracts personnel perform a key role in the Project Team. They bring together contractual, commercial and technical knowledge in order to provide contractual and commercial guidance to the project team and the wider organisation. 1. MAJOR RESPONSIBILITY AREAS 1.1 Identify the Major Duties and Tasks Accomplished by this Position. (a) Organise and maintain logs and files (both in terms of a central database and hard copy filing systems) in a systematic manner to allow for easy access by other department personnel. (b) Post client contract award, management of prequalification and RFQs for high risk contracts under the guidance of the PCM. (c) Lead negotiations and manage low to medium risk contracts. Participate in negotiations and drafting of high risk contracts. Drafting of internal approval sheet and obtaining the various levels of approval for all contracts. (d) Post award subcontract management, drafting and/or review and approval of subcontract notices, amendments, change requests and change orders, warranty claims, and formalization of subcontract closeout. Support procurement re negotiation of purchase order terms and conditions and resolution of claims. (e) Establish high quality cooperation and team work. Contribute to a positive work environment. Fosters cooperation and transparency across teams, functions, entities, countries and regions. 2. RELATIONSHIP RESPONSIBILITIES 2.1 Indicate Positions that report directly to this Position. Number of Direct / Indirect Reports. 2.2 Indicate Internal / External Contacts and Purpose of Contacts. Leads subordinate commercial / contracts personnel assigned by the Contracts & Commercial Head to operationally report to this Position. (a) Frequent interaction with and starting to influence internal stakeholders. Leading and starting to shape others in a team environment. (b) Frequent interaction with and starting to influence external stakeholders. Effectively leading engagement with contractors for small to large size (value, risk, complexity) contracts to deliver value-add. 3. REQUIREMENTS 5.1 Qualifications: (a) Bachelor's degree in a relevant area such as Law or quantity surveying / Master's qualification in a relevant subject such as construction law, business administration or economics will be of value. Law and contract law as part of academic studies is preferred. (b) MRICS, MCIArb, SCL is an advantage (a) Very high level of written and spoken English. Able to draft clear and concise correspondence. Excellent interpersonal and communication skills. (b) A high level of comprehension in order to understand and interpret contractual language coupled with an ability to formulate arguments that support the contractual interpretation sought by the company. 5.2 Work Experience: Minimum 12 years relevant experience Industry & Project Execution Knowledge (a) A preference for upstream oil and gas experience working for owner and contractor organisations in a project delivery environment. (b) Construction contracts experience (c) An understanding of technical, commercial, contractual and execution risk in a construction contracts environment and the inter relationships and trade offs between each of these aspects. (d) Engineering, procurement, fabrication, offshore construction and installation and commissioning (e) Planning and scheduling (f) Understand how a project team is organised and the inter relationship between the various project functions and with corporate legal, insurance and finance groups Legal and Contractual Knowledge (a) Understand the basics of the legal system with a focus on common law jurisdictions - How laws are made, and rights enforced (b) Understand the law of tort and civil wrongs and the impact on contractual relationships (c) Have a detailed knowledge and understanding of contract law . Contract formulation . Obligations of the Partiers . Breach of contract . Remedies for breach . Termination . Damages . Enforcement (d) Have a deep understanding of construction law . Allocation of risk between the Parties . Obligations of the Parties . Quality of the work . Time for completion . Delay . Extensions of time . Changes and Variations . Contractual basis . Methods of evaluating quantum . Dispute resolution (e) Insurance - CAR (f) Bank guarantees and performance bonds (g) Charter parties Commercial Knowledge (a) Contracting strategy . Types of contract and the associated risk allocation . Evaluation and assessment of the most appropriate form of contracting for a given situation - How developed is the scope of work, time and cost constraints (b) Methods of reimbursement - Lump sum, measured work, reimbursable, hybrid (c) The tendering process . Preparing Invitation to Tender documentation, liaising with and understanding the contract user or owner's needs, .
