We are currently seeking a high calibre professional to join our team as a Senior Legal Counsel Data Privacy Lead. Principal Responsibilities
We are currently seeking an experienced individual to join this team in the role of Senior Legal Counsel Data Privacy Lead Lawyer. Reporting to the fintech’s General Counsel, the role holder will lead on data protection and privacy for our new FX and Payments business globally, and support on commercial matters. The role holder will be expected to lead and manage their own matters and integrate fully into the fast and agile fintech culture of the business.   • Provide advice and guidance on all aspects of data protection and privacy risk including the records required to demonstrate compliance, risk identification, assessment, mitigation, response and reporting
  • Act as the DPO for our fintech group companies where required, including fulling the statutory requirements of the DPO under GDPR in UK and EU
  • Lead support to the new business on data privacy processes including subject access requests (‘SARs’) and data protection impact assessments (‘DPIA’), and helping to monitor their performance
  • Lead support to the new business and the General Counsel in the assessment of privacy compliance of third parties and the negotiation and implementation of appropriate contractual and other protections to manage data protection and privacy risk in respect of third parties
  • Lead support to the new business on data transfers and data protection and privacy compliance in a global context
  • Lead the design, development and renewal of data protection and privacy risk policy and minimum control standards with regular engagement with the business and wider HSBC risk and Legal functions, to ensure the control environment pertaining to data protection and privacy risk is suitably robust and fit for purpose within risk appetite
  • Drive and monitor compliance with the data protection and privacy requirements, and with internal business policies and controls relating to the protection of personal data, including in respect of the assignment of responsibilities, awareness-raising and staff training, and related audits
  • Build, own and maintain strong relationships internally within the business, in particular with commercial, marketing, technology and regulatory personnel
  • Build, own and maintain external relationships with third parties, including external legal advisors, regulators and industry forums where appropriate
  • Engaging with the wider Legal community within HSBC
  • Help manage the negotiation of third party tech, marketing and other third party vendor and partner contracts, leveraging support from HSBC’s wider Legal function as appropriate
  • Supporting the General Counsel with matters pertaining to wider legal risk where appropriate

  • Legal knowledge in the areas of data privacy and protection as they impact global retail banking including multi-currency operations, payment and cross border transactions, as well as digital banking models and digital wallets
  • Ability to proactively identify and address data protection and privacy risks, requirements and issues associated with the business drawing on experience from other data protection and privacy specialists within the Legal Function and other Functions of HSBC
  • Excellent knowledge of the data protection and privacy laws and regulations relevant to the business
  • Ability to develop and present balanced recommendations to facilitate decision making to support the business
  • Excellent legal research skills, a “can-do” attitude and a hands-on approach. This will be very client facing and you will be expected to own and drive delivery of legal advice and DPO support and be an active partner in helping the business achieve good business outcomes
  • Organised and happy to adopt legal technology to support your work where appropriate
To be considered for this role, the relevant rights to work in Singapore is required. The chosen candidate for this role will be required to undergo enhanced vetting. Subject to local laws, this will require the individual to satisfactorily pass a series of additional checks as part of the recruitment process and on an ongoing basis, if appointed to the role.
