They bring together contractual, commercial and technical knowledge in order to provide contractual and commercial guidance to the project team and the wider organisation Legal and Contractual Knowledge Understand the basics of the legal system with a focus on common law jurisdictions - How laws are made, and rights enforced Understand the law of tort and civil wrongs and the impact on contractual relationships Have a detailed knowledge and understanding of contract law - Contract formulation - Obligations of the Partiers - Breach of contract - Remedies for breach - Termination - Damages - Enforcement Have a deep understanding of construction law - Allocation of risk between the Parties - Obligations of the Parties - Quality of the work - Time for completion - Delay - Extensions of time - Changes and Variations - Contractual basis - Methods of evaluating quantum - Dispute resolution Insurance - CAR - Bank guarantees and performance bonds Charter parties Commercial Knowledge Contracting strategy - Types of contract and the associated risk allocation - Evaluation and assessment of the most appropriate form of contracting for a given situation - How developed is the scope of work - time and cost constraints Methods of reimbursement - Lump sum, measured work, reimbursable, hybrid The tendering process - Preparing Invitation to Tender documentation, liaising with and understanding the contract user or owner's needs, Tender evaluation - Technical, commercial and risk assessment, preparation of recommendations to award Contracts and commercial management experience with a focus on contract changes/variations and claims Technical Knowledge Oil and Gas industry Engineering, procurement, fabrication, offshore construction and installation and commissioning Planning and scheduling Requirements Bachelor's degree in a relevant area such as Law or quantity surveying / Master's qualification in a relevant subject such as construction law, business administration or economics will be of value. Law and contract law as part of academic studies is preferred. MRICS, MCIArb, SCL is an advantage Very high level of written and spoken English. Able to draft clear and concise correspondence. Excellent interpersonal and communication skills. For junior roles three to five years experience in similar roles. For senior roles ten years plus experience in similar roles. Language Ability Very high level of written and spoken English. Able to draft clear and concise correspondence. A writing style that avoids clich s and communicates a message at various levels. This will often mean being silent and not raising an issue. A high level of contract drafting expertise. An ability to propose constructive solutions and work arounds to resolve blocking points during contract negotiation. A high level of comprehension in order to understand and interpret contractual language coupled with an ability to formulate arguments that support the contractual interpretation sought by the company.
