Job Description


Summarize the Major Function and Purpose of the Position: Contracts personnel perform a key role in the Project Team. They bring together contractual, commercial and technical knowledge in order to provide contractual and commercial guidance to the project team and the wider organisation. Responsibilities:

  • Assist and support line management with organising and maintaining logs and files (both in terms of a central database and hard copy filing systems) in a systematic manner to allow for easy access.
  • Post Client contract award, assist in the preparation of pre-qualification activities, and RFQs for subcontracts and department.
  • Exposure to drafting of low risk and/or small size contracts. Drafting of internal approval sheet for low risk contracts and obtaining the various levels of approval for all contracts.
  • Exposure to subcontract management, drafting and/or review and approval of subcontract notices, amendments, change requests and change orders and formalization of subcontract closeout.

Requirements:
  • Bachelor\xe2\x80\x99s degree in a relevant area such as Law or quantity surveying / Master\xe2\x80\x99s qualification in a relevant subject such as construction law, business administration or economics will be of value. Law and contract law as part of academic studies is preferred.
  • MRICS, MCIArb, SCL is an advantage
  • Able to draft clear and concise correspondence. Excellent interpersonal and communication skills.
  • A high level of comprehension in order to understand and interpret contractual language coupled with an ability to formulate arguments that support the contractual interpretation sought by the company
  • Minimum 3 years relevant experience
Industry & Project Execution Knowledge:
  • A preference for upstream oil and gas experience working for owner and contractor organisations in a project delivery environment.
  • Construction contracts experience
  • An understanding of technical, commercial, contractual and execution risk in a construction contracts environment and the inter relationships and trade offs between each of these aspects.
  • Engineering, procurement, fabrication, offshore construction and installation and commissioning
  • Planning and scheduling
  • Understand how a project team is organised and the inter relationship between the various project functions and with corporate legal, insurance and finance groups
Legal and Contractual Knowleged:
  • Understand the basics of the legal system with a focus on common law jurisdictions \xe2\x80\x93 How laws are made, and rights enforced
  • Understand the law of tort and civil wrongs and the impact on contractual relationships
  • Have a detailed knowledge and understanding of contract law (Contract Formulation, Obligation of the partiers, Breach of Contract, Remedies for Breach, Termination, Damages, Enforcement)
  • Have a deep understanding of construction law (Allocation of Risk between the parties, Obligation of the parties, Quality of the work, Time of completion, Delay, Extension of time, Changes and variations, Cotractural basis, Methods of evaluating quantum, Dispute resolution)
  • Insurance - CAR
  • Bank quarantees and performance bonds
  • Charter Parties
Commercial Knowledge:
  • Contracting strategy (Types of contracts and the associated risk allocation, evaluation and assessment of the most appropriate form of contracting for a given situation)
  • Method of Reimbursement
  • The Tendering process
  • Contracts and commercial management experience with a focus on contract changes/variations and claims
Technical Knowledge:
  • Contracts drafting and negotiation experience
  • Management of the tendering process
  • Contracts and commercial management - Contract changes/variations and claims management \xe2\x80\x93 Ability to close out contracts and subcontracts pragmatically
  • Subcontractor and vendor management
  • An understanding of dispute avoidance and resolution
