About the Job This role requires identification of legal risks and advice to cross-functional international business partners on all areas of commercial law - including drafting and negotiating of contracts, legal advice on marketing and advertising law, intellectual property law, regulatory and compliance matters, distribution channels, pricing, privacy, e-commerce, data protection and competition law. Experience of working in a global consumer health or personal care and beauty industry is preferable. The role may require attendance at leadership meetings and/or external engagement, as well as travel. As our General Counsel, you will be reporting to our CEO. This is a part-time position, which will require candidates to work 3 days a week. Responsibilities Marketing and Consumer LawProvide training to, and work closely with, brand teams in assessing marketing claims and executing promotional campaigns. Provide advice to the growth team on ways to provide SMS and email marketing that remains compliant with privacy laws. Draft and negotiate contracts with marketing and PR agencies, brand ambassadors, social media influencers and content providers such as photographers and record companies. Draft and implement website, sales, loyalty program and subscription T&Cs. Commercial Contracts Draft, review and negotiate all relevant contracts including with:Retailers SEO, digital growth and e-commerce providers IT and ERP system providers Payment providers Manufacturers Warehouse and transport suppliers Commercial landlords and subtenants Compliance, finance and other professional service providers Contract database management Privacy and Data ProtectionMaintain data protection compliance including in regards to privacy and cookies policies, direct marketing and employee consents, review of third-party service contracts and upgrades to hardware, software, IT systems and security such as 2FA/MFA. Manage any data breaches, including coordinating with the Board, management and customer service teams drafting notices to customers and regulators and responding to enquiries from regulators. Run training for staff on data protection and IT security. Serve as Data Protection Officer for the corporate group. Intellectual PropertyProvide training to, and work closely with, innovations team in assessing new product names. Advise the business on the viability of potential new brands/ trademark applications. Defend trademark applications where challenged, including gathering and submitting required evidence. Manage IP portfolio of 80+ trademarks across 16 different countries and supervise external counsel where needed. Carry out enforcement strategies to achieve commercial outcomes eg. cease and desist letters focusing on breach of trademark, copyright, passing off and misleading and deceptive conduct takedown notices on marketplaces such as Amazon and social media sites such as Facebook and Instagram. Manage AI technology to identify and enforce against counterfeits and copycats. PeopleDraft employment and independent contractor agreements across all locations. Advise on non-compete, termination and redundancy issues globally. LitigationRespond, and coordinate with external counsel in relation to, any claims made against the group. Initiate claims on the group's behalf where required. M&AAssist management and the finance team with any fundraising and M&A activities. General DutiesBuild strong relationships with stakeholders. Identify and explain legal risks to business partners including proposing solutions to help navigate risks. Conduct research into applicable areas of existing or emerging law. Provide legal updates to, and share know-how within, the executive team. Your Profile Law degree Must have experience in the FMCG industry Experience within the cosmetics industry is an advantage, but not essential Proven experience in negotiating, drafting and concluding a wide variety of global commercial contracts Proven experience in providing legal advice to marketing colleagues on global campaigns, including advising on product positioning, claims and evaluating relevant legal and regulatory risks. Experience in data protection, digital marketing and promotions and competitions is desirable. Experience of working within global teams Strong organisational and prioritisation skills: experience of managing competing deadlines and priorities at short notice. Ability to assimilate information quickly, identify legal risks and provide pragmatic, commercial advice to the business, or offer a solution based approach Ability to lead decisions and to work independently, including coordinating input from several global business partners, such as legal, R&D, regulatory and procurement Excellent written and oral communication skills: ability to communicate with global business partners in different time zones and with countries where English is often not the first language Proven leadership skills: Attending and advising our leadership team on legal matters as necessary Proficient in Microsoft Word, Excel, PowerPoint In Return You Will Get Flat hierarchy and co-operative international working environment Freedom to execute your own ideas Lifestyle Spending Account Competitive package Health Insurance package This job has everything for the right applicant, and is available immediately.
