It will also be responsible for developing appropriate internal precedents and know-how to facilitate timely and up-to-date support. The role will also provide competition law advice and support more generally across our Businesses and Functions when required.In addition, the role will provide input into the Competition Law Compliance Framework, including the development of supporting materials, monitoring and other second line accountabilities.

  • Engage with external counsels and counterparties to manage competition law risk
  • Provide expert advice on all aspects of competition law compliance with a particular focus on Marketing, Procurement and Potash.
  • Provide updates and advice, including to senior management, on relevant developments in competition law enforcement and policy and the potential impact for BHP. Incorporate relevant developments into the Competition Law Compliance Framework and associated guidance and precedents.
  • Develop relationships with relevant competition law organisations as required to remain up-to-date on current enforcement practices.
  • Develop and lead training on competition law compliance
  • Collaborate with colleagues across the Businesses and Functions as required, including in Compliance, Government Relations/Corporate Affairs, Legal and Commercial on competition law policy issues and external engagement, including the implementation of appropriate governance arrangements.
  • Reviewing or inputting into (as appropriate), with support from Corporate Affairs and Legal colleagues, public policy positions and submissions in relation to competition law policy issues;
  • Provide competition law expertise to relevant BHP priorities and functions including collaborations with third parties (e.g. on climate change and biodiversity) and the growth strategy;
  • Contribute to internal material on competition law related public policy positioning, including material for senior management (Board and ELT level); and
  • Provide subject matter expertise on Group Material Risks and Emerging Risks touching on competition law compliance.
  • Provide input into the Competition Law Compliance Framework, including the development of supporting materials, monitoring and other second line accountabilities
About You
  • Functional expertise in competition law, including relevant domestic and international legal frameworks.
  • At least 8 years PQE as a competition lawyer SME, including at least 5 years expertise in advising on cross-border / multi-national competition issues, with broad experience across multiple jurisdictions globally.
  • Excellent written and oral communication skills, including an ability to draft sound and logical advice particularly for internal audiences (including senior audiences through Board and ELT papers).
  • Excellent analytical skills with an ability to undertake critical thinking and analysis on complex issues.
  • Deep understanding of global competition law enforcement landscape, including key soft law frameworks and emerging trends.
  • Law (must be legally qualified and have a practicing certificate if applicable in the relevant jurisdiction)
